Two new lawsuits filed yesterday, one in NJ challenging the recently passed hemp prohibition bill and another in CA challenging the CDPH’s emergency regulation prohibiting hemp products with detectable amounts of THC.

hahaha did they grab the decoy stash containers thinking there was drugs in them?

I’m curious too. It says 1800kg marijuana products but just shows the trademark infringing stuff and the stash cans

redditors are saying all the stores had the THCa pulled as well

Was this a couple years ago? If this was recent its a Shamefull use of leo when there is a giant humanitarian crisis in need of emergency ,search and rescue personel , safety checks.

Surprised that this hasn’t been posted yet - is the DEA actually part of these raids?

IN the early morning hours of late September, some 30 Drug Enforcement Administration agents in tactical gear, with high-powered rifles drawn, raided a warehouse near Raleigh, North Carolina. The officers seized intoxicating hemp-derived THC vapes and joints, along with cash, computers and cars.

The agents, who were armed with a federal search warrant, froze the company’s $1.5 million bank account, and seized half a million dollars’ worth of product.

“They came in full force,” says Jay, the founder of the Wake County-based hemp product manufacturer and distributor who did not want to use his full name due to fear of legal repercussions. (Jay has not been arrested nor charged with a crime.)

Jay’s company, which he founded in 2019, generates about $60 million in annual revenue by selling hemp-derived products with enough delta-9-tetrahydrocanninol, or THC, the main psychoactive compound in cannabis, to get people stoned. But he says his products are federally legal under the [2018 Farm Bill], which allows the production of hemp and all its derivatives so long as it contains 0.3% of THC or less. Jay says his products are within the legal limit. “I feel like we are currently at war with law enforcement on what we believe is legal,” Jay says.

Over the last several months, joint state and federal task forces have raided more than 100 vape and smoke shops, hemp product manufacturers and distributors in North Carolina, alleging that they are selling marijuana disguised as hemp.

Not everyone in hemp thinks enforcement is a bad idea. Justin Journay, the founder and CEO of 3Chi, one of the nation’s largest hemp-derived product manufacturers says years of no enforcement have created bad actors who are selling marijuana pretending to be hemp. The fact is that the hemp market is littered with bad products with dangerously high THC levels and operators who sell to children.

The operation vapor trail/Allen, TX ones both had DEA, the only other I’m aware of is the Mississippi city councilman who added PINACA type cannabinoids to his ‘hemp’ products

Sounds like an example of the usual early-mid 20s induction of severe mental illness. Maybe aggravated by THC use, but not enough to justify scapegoating Delta 8. Just sad all around. Seems like the kid probably lost his parents recently too.

‘…NJHAA was partially preempted by the Farm Bill and violated the dormant Commerce Clause by favoring in-state producers over out-of-state producers. The law’s definition of THC, which includes “total THC,” imposes illegal restrictions on products that comply with federal regulations.

The court granted partial summary judgment, agreeing with the plaintiffs that the NJHAA’s restrictions on out-of-state hemp products, particularly its criminalization of products containing more than 0.3%, of total THC, were inconsistent with the express preemption clause of the Farm Bill. This clause prevents states from imposing limits on the transportation of hemp products that meet federal standards.’

The court’s decision was a nearly complete win for the state. It essentially only struck threw words from the definition of “intoxicating hemp products” which would now allow “intoxicating hemp products” to be made out of state, not just in NJ. But all “intoxicating hemp products” are still subject to the stringent restrictions contained in the NJHAA (i.e., all products over .5mg THC/serving and 2.5mg THC/package must be removed from shelves starting 10/12; these products will still be considered cannabis product and can only be sold in a licensed dispensary or liquor store once the CRC promulgates rules, etc.)

In yet another hemp litigation update, a California court denied the US Hemp Roundtable’s motion for a TRO which tried to stop enforcement of CA’s emergency hemp rules.
