They can but doesn’t make it legal. States have the right to make their own laws The tenth amendment makes that pretty clear. If the dea came in and raided big California players California would come to their defense. It would end up being CA vs US and the fed doesn’t want to have that go to court. Because then it would become common knowledge that they have been over stepping for years. They would end up losing alot of power to the states( as they should)if they lost that case

Decarbing happens naturally over time.the dea considers thca and thc the same thing . Adding heat to decarb and putting cbd in a reactor and adding a chemical soup to to turn it into d8 are two completely different things if you cannot see that your not even worth my time.
Doesn’t matter if it happens naturally or not, it’s still a reaction caused by heat. The Feds obviously don’t consider d8 and d9 the same or they’d have included d8 in total thc count which we all know they didn’t. They specifically said in the final rules d8 doesn’t need to be tested for in total Thc amounts.

Probably not because you’d understand how d8 is a neutraceutical since it’s HEMP derived and not synthetic (pharmaceuticals are synthetics)
Hemp derived = neutraceutical
Synthetic = pharmaceutical
Remember the definition of hemp
“any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers,” with no more than a 0.3 percent concentration of THC.”
Last time I checked d8 is an isomer of cbd, and it falls under the definition of hemp as long as its under .3% d9 (all derivatives whether grown or not are legal under .3% d9 when derived from hemp)

A few days ago I saw a retail store that carry’s my products had started selling delta 8.
They literally just bought a kg of cheap delta 8 and put it in 5ml containers to sell. No way in hell it’s compliant, might as well be selling delta 9. They also have those terrible koi D8 vapes that apparently turn black halfway down once all the cut is burned.
This is not good.
It makes you wonder why are we in this business? To help people, or to exploit loopholes for quick cash and sell chemical soup that might get you high?
I’m all for delta 8 that’s 99+% TAC but most brands will not give a flying fuck about unknowns or potentially dangerous to consume products.

“The dea has no authority to regulate drugs that have not been scheduled, and it has no followed the procedure required to schedule a substance”
D8 isn’t scheduled D9 is and d8 is illegal by the analogue act
Right above that it talks about how the dea CAN regulate synthetic THC and thcs from MJ, but they CANNOT regulate naturally occuring thcs contained within legal hemp or from a product excluded from from definition of the CSA(the final rules explicitly said d8 is naturally occuring)
Idk how you can argue with a court case

They may NOT be dying from what you’re making, but it’s going to start happening soon. All these mentally challenged individuals are figuring out they can make D8 from CBD with acid… We’ve seen 4 people in the last WEEK that have come here claiming such high intelligences, but they don’t know what size reactor they need, or even was acid works best.
BUT these people know better than anyone here apparently according to their postings. These are the people that will be killing people, and after another week or two I won’t touch D8 period, from anyone, EVER.

Literally, the first time I EVER smoked it was maybe 8 months ago when I ordered some of it, along with what was supposed THCV. 1st experience. Second time smoking it was about 2-3 months ago when I ordered an OZ from someone. Received gold colored disty with like qualities to D9. Smoked most of that 1 to be honest, and I felt fine.
This shit I got a couple of weeks ago (Bright Red in color) is what has changed my opinion on EVERYTHING. It’s scary to me, that I order something from the homies that does something to me that 25 years of smoking hasn’t cumulatively done to me. That’s what I mean by it’s good till it’s not… Perfect Example…

Your processes are good, and this isn’t in relation to your product, it’s in relation to the HUGE source of shittily converted crude being thrown onto the market. That’s how they do it up here, and they do it when they’re distilling their D9 so they have varying levels of low D8 1%-35%, 60% or less D9, and around 78%-90% cannabinoids.
I can’t understand why #1. Why someone would buy that shit, and #2 Why someone would make it? It’s like it make it exotic, or something. I don’t know, I quite buying from the stores 2 months ago because of weird shit like that
