What are the downsides/Upsides of creating a business just for THCA solely?
Just some questions that peaked interest in my head and decided to shoot it over here would appreciate some good arguments and such on these topics thank you.
Is it actually too late or is there some time left to make a few quick bucks?
I have a good relationship with some head shops and wanted to see if its still a opportunity to cash a quick check and move onto other alt noids atleast then there will be some “Trust” with the name idk.
At the Federal level, all signs point to the hemp loophole being closed when the new farm bill passes. They’re going to extend the current rules for one more year. It might not be a full year, though, just depends on when the new bill passes.
I figured it would’ve been closed sooner then later, Im just trying to find out if its too late to even try to enter i’ve heard you can just start a online storefront in NC and just loophole there due to no licensing but on the other hand im still lost on the actual LEGAL part and don’t want to fall prone to any error due to me lacking resources to find this info.
Yo brother, i’ve been doing the same research. Here is what ive found:
Companies want you to buy a pound to sample. The samples ive received so far are good.
If you do your own testing on samples, then you will see that most are non-compliant (0.4 or higher). Im sure there are many reasons for this, but the older the flower is the more likely it’s non-compliant. Im sure the flower in the shops is the same.
You will need to provide COAs. Most ive seen have the origin whited out.
I would look for a company that is up-front and verifiable. A few exist. Some are on this forum, but from my experience, you’re just as likely to find equally unhelpful people on here.
I havent pulled the trigger on thca flower; still looking for a supplier that can provide me a compliant product that I can do ny own third party testing on.

Ya I think the key to all of these is being able to claim that you were under the impression what you were doing was legal, because for there to be a crime there has to be “intent”
That being said, I’ve avoided THCa for the main part because i’m not ready to catch a case and have to defend myself. Thats the big risk here, your products are likely not compiant, even if you are under the impression that they are, you may not have intent to commit a crime, but I dont want to have to prove that to a DA or a judge.
I’ve got friends going thru it in the South cause they were successful at selling THCa flower, now they have liens and large legal bills, and a great lawyer and I’m helping educate the lawyer where I can. They may win but I dont have time for all that. Civil forfeiture ect ect. Sounds like a huge headache there are more profitable avenues in the hemp industry still, believe it or dont.
I once went and pulled all of the local med dispo concentrate CoA’s to show how many are under 0.3% and technically hemp products are being sold and that in theory we could be able to sell the same products.
Personally I think the best way is if you focused in fresh frozen&cold processing live resin&rosin. Hypothetically I imagined it done like quality cbg even. Process only to concentrates and keep everything refrigerated.
But I think any disposable THCa vape product sounds negligent, even if you work on a perfect formulation the first time someone uses it, odds are the product is now hot & that consumer is now at risk. I think it’s fucked up to sell products to people under the concept that it is legal knowing that you are only protecting yourself, and putting the risk on your customer. In terms of concentrates I think you could theoretically put in the effort to keep everything compliant, regardless if it’s redundant.
