I struggle to see what’s novel about any of it really. Extraction and purification of organics has been around for quite a while, but I’m not a lawyer so that’s all lost on me.

These guys arnt the only ones about to drop the hammer on patents, this industry is about to get even smaller, I hope all the consultants/labs selling/making ANY cannabinoid isolate/diamond process are ready to fight, a big patent group from Texas is about to go after 1000s of labs and individuals

I have some cold ethanol process stuff meta dated from 2011, specifically around large scale cannabis extraction, and i was pushing the cold ethanol process over BHO. I would never consider myself an expert witness but if you need any discovery type help let me know.

Fight this battle politically.

There is an opportunity to push for federal cannabis legalization which can involve patent reform.

2024 is an opportunity. Seize it America.

With all the prior art in the public domain, how these people could be awarded patents speaks to the ignorance of the USPTO and the relevant courts. It’s this kind of stuff that makes people want to resort to more extreme measures.

Just my 2 cents here. I am not an expert in any means and not involved with anything here so take what I say with a grain of salt.
Big picture is that the industry is not in a great spot. Now that everyone is weak is the best time to strike from the patent holders perspective. Regardless of the validity of the patents everyone may have to defend against it. Basically that means a tax is being levied against the entire industry. To battle against it everyone can join forces or merge but in either case the tax aka the lawyers will have to be paid. Margins are squeezed on both ends so further consolidation is underway.
Patents are the game of kings. There are few who can currently play this game. If I’m looking from the bright side there will be fewer players and supply and demand might become into balance more quickly so those that survive may take part of a healthy market more quickly. These patent cases are forcing what would be a 5-15 year process of dying by a thousands cuts into a much shorter time frame.

Couldn’t a Chinese company could just make ASME equipment and not be subject to patent laws? Or does the patent then prevent them from selling in the US? This kinda seems like China’s bread and butter - even if they are subject to patent laws, the burden is on the patent holder to prove it and the Chinese distributer could just ride it till they can’t, then change names and repeat?

the patent is on the process of hydrocarbon extraction I believe, not just equipment. So, I don’t think it matters where the equipment is made. they are said to be going after operators as well, not just manufacturers of equipment.

Im just happy all the labs that licensed IP from me are protected, with fed legalization coming and the case in cali stating that cannabis patents are enforceable because hemp which is technically cannabis isnt subject to the CSA, means patent law is about to change this industry forever

aren’t they going after anyone using hydrocarbons to extract cannabis? don’t you use hydrocarbons to extract cannabis?

sorry if I’m misunderstanding, but how would anyone that is extracting with hydrocarbons be protected unless they are part of the group that owns the patent?

XD I helped patent a rosin press to a Chad in Ohio lmao doubt it ever sees any $. Sops and methods and stuff have way better luck than machines.

Lmao they’re gonna be hard pressed to ask other people to divulge their sops. Hey tell us your SOP so we can prove it’s ours. Trade secrets however we’re gonna see people paying imo. Up the wazoo. Once it can be proven and big tax man gets his share. Everyone’s gonna be crying.
