The analogue act is the problem, especially at a federal level. Delta 8 is clearly an analogue of delta 9. That is exactly how cancer.gov defines it.
The rules are poorly written and do create the appearance of a loophole. It is tempting to seize that loophole and run with it, but how strong is that argument really, that anything made with hemp is legal? First of all, it is coming from cbd isolate, not hemp. There is also a delta 9 byproduct in the conversion. No one is making the claim that the resulting delta 9 is legal. Why not? It âcame from hempâ too. I donât even know the possession guidelines for the d9, float it in solvent to lessen the %? (Then make black market vapes)
Legislative intent is another clear argument against delta 8 being legal. No one ever meant for the hemp rules to be a way for anyone to get high. The fact that several states have moved to make delta 8 expressly illegal is evidence of that. Youâre probably breaking state laws just by offering an illegal substance over the Internet into their state. (I hope no one actually ships to these states)

The analog act is part of the CSA, and by definition hemp is excluded from the CSA.
If you were to make a product over .3% d9 it would be no longer hemp by definition.
This is the reason the loophole for d8 exists and you canât just make d9 from it and say itâs legal because itâs derrived from hemp.
Let me sum it up for you. Why did the 2018 farm bill feel it necessary to redefine thca and total thc even though the analouge act clearly is defined precursors of thc. They did this becuase it was legal and they accidentally legalised mmj becuase its thca. They didnt feel it necessary to clearly define delta 8⌠why⌠BECUASE ITS LEGAL

@Kingofthekush420 had this correctly nailed about a year ago long before anyone else. The problem D8 sellers run into is state code in several states. Specifically, controlled substance code that does not word for word replicate federal code, (normally state code follows fed code word for word cut/paste) but instead is modified and more broad in ways that outlaw D8.
