Delta 8/intoxicating hemp regulatory and enforcement actions/news

Given how strict the barrier of entry to get a med card in KY is, there ain’t no bullshitting them. I maybe can do so for PTSD, but I have no markers for trauma. Even though I have been stabbed and then they subsequently attempted to set me on fire WHEN I WAS A CHILD. I rest easy at night knowing the person who did so was shot dead by their own father on their own birthday. Long story, but I have unpacked all this years ago through the use of microdots that were more earth-shattering than micro.

The hemp industry is a little different here, selling untested material here is the same charge as weed, and gets another felony tacked on. People do it but those people tend to get themselves arrested. Quick.

It ain’t the lobbying of @Bret_HoneyGold and those like him keeping The Bluegrass from a good medical program, it is straight-up Republicunt Shitkicker Nonsense. Which is weird because we mostly elect Democrat governors, but the rest of what we elect is notoriously awful. Gives me the sads talking about it because I have voted against the nonsense my whole adult life.

I refuse to move. Giving up is for bitches and quitters, and I ain’t either.

Sorry to hear that - but the high majority of medical programs start out like this. They will fairly quickly be adding new conditions and licensees.

If what you said was true about republicans there would be alot of states without med programs.

Only reason we got a med program at all is due to our Dem governor though.

And the other states that have more shitkicker nonsense than us have no med program. Some states that have less don’t have a med program at all.

40-3 has details about a ‘Kevin Schuette’ being convicted of a felony for a THCa pen bought at a headshop and complaints to the Texas Forensic Science Commission about post-decarb testing

Put simply legal thca becomes illegal delta non thc, when it is heated. In Texas,
the most common way criminal labs test canbinoids. Is gas chromatography
heating and vaporizing is sample is a necessary step in gas chromatography.
When thca is exposed to heat it undergoes a chemical reaction known as
decarboxtlation where it loses a carboxylic group add carbon dioxide and
water. This transformation changes t a c.A into illegal delta nine thc. If high
performance liquid chromatography had been used then i would not have
been convicted and I have hard time believing I’m the only one that knows this

[…]The Laboratory has interpreted Texas Agriculture Code Section 122.153 to require that hemp sample testing should be performed utilizing a post decarboxylation method that reflects the total available THC derived from the combined THC and THCA content. This testing method requires that THCA present in the plant sample be converted to THC before or during analysis. Section 122.153 proscribes preharvest testing but does not speak to forensic laboratory testing of vapes and oils. A United States Department of Agriculture (“USDA”) Rule clarified that for plant samples, the 0.3% threshold for determination of hemp versus marihuana was intended to be total THC (THC plus THCA). However, no such clarification has been made for non-plant evidence, such as vapes or oils.[…]

The court in the Alaska hemp action granted summary judgment to defendants. This follows the court’s denial of plaintiff’s motion for a preliminary injunction last year.

I am really sorry that all of that happened to you. I hope you don’t lose your access on top of all that. There was a time in Oregon (years and years) when we couldn’t take advantage of the medical program either. At that time you would get a CPS visit if you were on the medial program list. No thanks.

Here’s to brighter days and more access to the plant for all people.
