The legal opinion is by cannabis business law attorney Rod Kight, who asserts Goldwasser’s products are legal under state and federal law because they contain THC concentrations under .3%, regardless of their THCa content.
Kight’s analysis notes that Ohio law takes into account THCa when measuring THC levels to determine if a product is marijuana or hemp, but Kight says that Ohio’s definition is “preempted by federal law.”
“For these reasons, Goldwasser’s cannabis products are lawful under Ohio law. At a minimum, they are federally legal ‘hemp’ and do not constitute ‘marijuana’ under Ohio law,” the analysis says.

The entire Marijuana market in the USA is structured on a states rights argument. Under federalism the feds cannot stop the state from legalizing intrastate commerce if the state wishes to do so. To then turn that argument on its head and say that Ohio law is preempted by federal law, and that Ohio cannot use its own definition for Hemp is a bold move, on a legal opinion that has not been tested at the very least by a local appealate court. To risk mandatory prison time, to sell weed in public , to make a couple sheckles seems short sighted at best. When your playing with years instead of dollars, one would generally assume a little cautiousness is warranted.

On the 3rd, the Kinki Regional Bureau of Health and Welfare’s Narcotics Control Division and Osaka Customs announced that they had arrested and indicted a 37-year-old construction company president for importing large quantities of “cannabis liquid” and for manufacturing drugs by importing raw materials and manufacturing equipment for the cannabis component THC (tetrahydrocannabinol) from overseas. Large manufacturing equipment was seized from the related party, and the Narcotics Control Division is investigating the actual situation of manufacturing and sales. The suspect who was arrested and indicted on suspicion of violating the Narcotics Control Act is Ryuma Nakayama (37), the president of a construction company with no fixed address. According to the Narcotics Control Division, Nakayama is suspected of importing large quantities of cannabis liquid for commercial purposes from the United States on 10 occasions between August and September 2022 using international mail, as well as importing raw materials and manufacturing equipment for the cannabis component THC (tetrahydrocannabinol) from overseas and manufacturing them in a warehouse in Wakayama City.

The incident came to light when Osaka Customs seized approximately 14.8 kilograms of cannabis liquid in shampoo bottles and toy boxes during an inspection of imported mail. The street value is said to be equivalent to 160 million yen, and the mail is believed to have been received by acquaintances. Large THC manufacturing equipment was also seized from the related party. The Narcotics Control Department has not revealed whether Nakayama has admitted to the charges, but he has already been indicted on the cannabis liquid smuggling case.

They are smuggling THCH and HHC HHCP ect. All banned in the last 12 to 24 months in Japan. The "lab " is just a cart fillling op.
