I think this is where it gets interesting. Who trumps who? Congress passed a law (2018 farm bill) that says CBD, and all isomers, salts, etc are legal except d9 thc. Dea changes those rules without approval from Congress. Who wins?

That’s true, but authorial intent matters. As i said “I don’t know why anyone would have expected congress to be like “d9 bad, d8 good”.” I suspect if it goes to court they’ll either assume d8 was meant to be illegal or else pass an emergency revision in the law to say so explicitly
This has always been said in UN drug convention from 1961, there is one refference for (-)-trans-delta-9-thc, and anorher for all THC “isomers and stereochemical variants”… then various country included also HU-210 (the spice stuff), and DMHP.
But nthen, when it come to regulation and control of hemp products, cannabis in geeral, only d9 levels are regulated. In addition, CRMs are only available for d9, d8 and exo…
So unless those laws are adapted, and more CRMs are produced, it is hardly difficult to term when d8 is ok, and when it is not ok. It is even more elusive for the other isomers
i think the DEA move here was to close the hemp bill loopholes. They specifically reference it in the new rule. This is why lawyers are now advising their clients to stop and take down website. As they can no longer argue the loophole.
Im assuming there will be a mass shut down of all CBD companies until this is more classified. Id especially be nervous if your a CBD vendor or lab in a state without medical or rec marijuana laws as you have nothing to hide behind.

The emergency revision by congress would be valid for sure. I’m just not sure the DEA making a “clarification” that completely changes a definition laid out and codified in law cuts it.

The definition in the law was arcane and speaking to topics that nobody in congress really knows much about. In situations like that as i understand it, courts give wide credibility to arguments based around authorial intent. The clear fundamental idea behind the hemp bill was to legalize non-intoxicating cannabinoids, without allowing accumulation or sale of the intoxicating d9. As d8 is an intoxicating compound and allowing people to sell it willy nilly clearly runs contrary to this intention, i think courts will accept the argument that it was overlooked by the drafters.
If a court rules the other way, i expect an emergency revision within days. So either way I’d certainly be shutting down my d8 operation.

If isomer includes a broad definition of isomer, it could include any molecule with the same collection of atoms. It could be read to include almost all the cannabinoids we deal with except CBN because it isn’t an isomer

i work 7 days a week 365 days a year. I think if i work every single day from 40 to 50 i will be able to compleltly retire from everything at age 50 and just travel the world. By 50 my kid will be done with college, and i should be able to sail into the sunset. Im 42 now. Been working for just 2 years every single day.
This is my ultimate goal. i dont live some crazy expensive life… I still live on $700 a week income. The rest is in savings. i use all credit card points for toys and vacations.
