It’s a really unique loophole( still stupid ) if you look into it, as it relays so heavily on the literal writing of the revised hemp bill and some clarification statements from the Feds on what they consider HEMP( have clarified it must be over. 3 D9thc), so basically one finds states without their own hemp program, or ones that adhere to federal guidelines for testing, which states that other methods can be used to determine potancy besides a decarb, if they accurately measures the amount of active THC in the product, then they use another state testing loophole that some states follow the FED regs and only test and report for active D9, and not thca, while most others test for total THC which includes decarbed THCa, and boom you have legal loophole THCa from Hell! lol I know several states have changes the wording in ther legislation to become “total thc” states in the last year to mitigate this problem without having to deal with the costly lawsuits of just trying to shut everyone down

Tennessee was the only d9 only state I’m aware of, but that’s been patched. Hasn’t stopped the people slinging it over the internet, I saw one of them even went on the news recently
I’m not sure if creme is pretending to be doing hemp, there’s a waiver/ToS that says they’re your caregiver on their site(in TX…)
