Congressional Committee Launches Investigation Into FDA’s Decision Not To Regulate CBD

A Republican congressional committee chairman is demanding that the Food and Drug Administration (FDA) turn over documents relating to the agency’s decision not to regulate CBD products.

Rep. James Comer (R-KY), chair of the House Oversight and Accountability Committee, sent a letter to FDA Commissioner Robert Califf on Monday, announcing an investigation into the agency’s decision and criticizing the “insufficient rationale for inaction” on CBD regulations.

FDA said in January that, after years of review since hemp and its derivatives like CBD were legalized under the 2018 Farm Bill, it determined that there is not a regulatory pathway in place to enact rules allowing the non-intoxicating cannabinoid to be marketed as a food item or dietary supplement. It said that congressional action is required to develop CBD regulations.

Kind of think its a bit crazy.

FDA says - hey there, these are drug products and therefore you cannot have them in food. Citizens come back and say no no, we want to have them in food. FDA says, nope no food for you. Citizens come back and say dietary supplements? FDA says, nope no supplements for you. Citizens come back and say WTF give us our cannabinoids. FDA says, sorry there is no current pathway that works for your products which are drugs and therefore you must file NDA for them.

Of course no one wants to file NDA for them - that would take like 10 years AND then it would all just be generic… and probably another 15 years before it could be over the counter. And even then the prohibitionists would probably make it so you have to sign a form for it and limit purchase amounts like they do Sudafed. x.X

In any case - was in DC just last week. Good stuff going on there. There appear to be 3 camps in DC right now - one that says all cannabinoids are illegal and not intended and shall go back into Schedule 1 box. One that says only intoxicating cannabinoids are illegal and not intended and shall go back into Schedule 1 box. And one that says - create a new category for cannabinoids under the farm bill and all commerce to continue.

Which one do you think will win with a REP held house and a DEM held senate? Hmmm… if you haven’t already started talking to your congresspeople about how changes to the Farm Bill 2023 will impact your business… or how rescheduling/descheduling will impact your business…
