Calling Pro Delta 8 THC, CBN, Psychoactives Kentucky Business owners

Just saw a lawsuit was filed in GA to stop the raids on D8 shops. Good for them and I will be rooting them on!

We had a similar issues here in KY where a local police dept tried to CYA on the Delta 8, but said there was THC and the shop owners were unaware they were selling marijuana products. NEVER said the limits and never showed testing results. They said a field test for THC was done. Well DUH! All full spectrum or Delta8/10 will fail a field test for THC. The ignorance is high!

Also, in KY, drug task force departments used the opinion letter from General Counsel to obtain warrants to raid local hemp shops. Those cases are still pending as well. Our temporary injunction should stop all of this, but there are still smaller police departments just going in and taking product without even getting warrants. The war on cannabis is alive and well in the Bluegrass unfortunately.

I wonder if you couldn’t get the method for this test, validate its suitability for the purpose and drop the case on the almost certain inability for their field test to sufficiently differentiate d8/d9 and quantify it to 0.3% on the spot. They got a GC in the armored van?

If I was an attorney, that is how I would handle the case. But since I am not and only have a paralegal degree, people can’t take my advice :wink:
Hopefully, their attorney is smart enough to ask for that. Field tests for THC is outdated and 100% unconstitutional when it comes to hemp derived products imo.

Bill has still not been passed over to house… no news is good news. Although crickets is a little scary.

Bill was passed to the house. It has not made it to a committee. They could still tack it to a pending bill however. That is the fear that some of us have. We are keeping our ears open though and will report.

I heard yesterday it has not actually been passed. And they are off today.

It was passed to the house from the senate, it has just not made it to a house committee - the AG committee is not meeting today. No votes have happened on the bill in the house if that is what you mean. There are other committees it could get assigned to, but honestly, it is late in the game. I am hopeful we managed to stop it, but that also doesn’t mean it couldn’t get tacked on to another bill that is about ready to pass. I am in direct contact with the President of the KYHA who is actually at Frankfort working with the lobbyists to make sure that doesn’t happen.

Pretty sure we have killed this bill! House leadership does not want an all out ban. Still work to be done though. Our lawsuit is still pending and set for a final hearing on 4/22/22. Hoping we can win that and move forward here in KY!!!

A new bill was proposed, but does not look like there is enough time to get it through. God willing.

The new proposed bill was proposed by the KYHA, but time is running out. The KDA didn’t agree to it as is. 4/15 is the end of the legislative session. So hopefully the bill is dead as originally written and the KYHA can be proactive for the next legislative session.

What notable changes did KYHA propose in new bill? Is there a link to it I can read

21+, COA’s, product behind the counter. Make flower and all cannabinoids legal. I only saw a draft - not the final version. It is def WAY better!

I wouldn’t want to see anyone’s livelihood threatened, but at the same time time, speaking from a formal chemist’s perspective, I can’t help but wonder who and how all this d8 is being made and who is actually doing proper validation, characterization and quality control to understand what reaction byproducts are being generated and how to best reproducibly purify crude reaction mixtures to an end product acceptable for human use. It’s one thing to mix a bunch of chemicals to generate a crude product, its a whole next level effort to properly characterize and validate a process. I’ve enjoyed cannabis for nearly 20 years and there’s not a chance in hell I would consume any delta-8, hhc, thc-o-acetate out there in the market at this time for the reasons I mentioned. If delta 9 was outright legal in all states, would there even be this market push to overproduce these minor cannabinoids? Just my opinion but maybe its time to focus efforts on removing this ridiculous legal distinction between hemp and cannabis, its the same plant
