Either way, if d8 was synthetic it wouldn’t need new regulations to cover a “loophole” as the state called it in that article

Well that really makes no difference. If they want they can just write a clause saying “d8 is a synthetic cannabinoid” and then that’s what we have to go by. Just like how they said CO2 was a hydrocarbon when by definition it’s not. People tried to challenge them on it, didn’t work.
In regards to the other point, that they are banning all agonists other than THC and CBD, yes, obviously that doesn’t work because there’s like 200 cannabinoids in cannabis and a lot haven’t even had their activity tested in the first place. I’m sure they will probably do a revision soon that says it only applies to certain ones. Remember that’s not a clause yet, it’s just an idea they tossed out.
