Texas strikes blow to industry offering life sentence for cannabis

Not only does Texas still offer harsh mandatory minimum sentencing for cannabis laws, they now offer potential life sentences for hemp products.

Starting August 1st, possession of THC products that do not comply with the new regulations will be considered a state jail felony. Penalties are as follows:

  • Under 1 gram: 180 days to two years in jail and a fine of up to $10,000
  • Up to 4 grams: Third-degree felony, up to 10 years in prison and a fine of up to $10,000
  • Up to 400 grams: Up to 20 years in prison and a fine of up to $10,000
  • More than 400 grams: Up to a life sentence and a fine of up to $50,000

Businesses caught selling illegal products face possible license revocation, plus fines of up to $10,000 per day for each day the products were sold.

Your fun weekend trying out two new carts in NewMexi just turned into 10 years in the slammer nextdoor in TX. Abbot needs to step back and take a long, long nap until they’re living in the same reality.

Good way to keep the Californians etc. out. That seems like the bat signal. Time will tell. If you’re old enough, welcome to the Regan years. They’re back on the menu. Bless Texas’s heart.

Prices bout to go crazy. They are a large consumer of Cali products.

I mean shit the high thca hemp industry is essentially the legal industry’s back door - the amount of people who have interests in both markets is absolutely fucking insane and makes you wonder who the fuck files their paperwork if some asshole like me could find it out

The Californian’s have been leaving for years. The only ones who’re still moving to Texas or staying are the conservatives who moved for political reason. The tech boom in Austin has slowed they’re experiencing negative job growth.

Shit, most cant afford it. Median income in Texas is pretty mids. Most residents are struggling. They love their cheap OKC packs down here. The affordability lie is a scam. Low wages, high taxes, insurance and energy rates. Ranked 8th in the country for foreclosure rates.

Even though power is more expensive in Cali, Texans on average still pay more.

Seems like hemp d9 is still legal. So gas station carts will still be available. The thc-a loophole seems to be closed for now.

Shitty they are grouping all of it together but this is one way to get all these chemical synthetics off the market.

Sucks that all cannabis isn’t legal here in Florida but at least we have medical. Good luck in Texas. Looks like a good way to monetize jail there

Flower is a misdemeanor up to 4oz, pretty much any cart is a felony now though

Here’s the new regulations

*(31) Tetrahydrocannabinols, meaning tetrahydrocannabinols naturally
contained in a plant of the genus Cannabis (cannabis plant), except for up to
0.3% delta-9-tetrahydrocannabinols in hemp (as defined under Texas
Agriculture Code 121), as well as synthetic equivalents of the substances
contained in the cannabis plant, or in the resinous extractives of such plant,
and/or synthetic substances, derivatives, and their isomers with similar
chemical structure and pharmacological activity to those substances
contained in the plant, such as the following:
1 cis or trans tetrahydrocannabinol, and their optical isomers;
6 cis or trans tetrahydrocannabinol, and their optical isomers;
3,4 cis or trans tetrahydrocannabinol, and its optical isomers;
(Since nomenclature of these substances is not internationally
standardized, compounds of these structures, regardless of numerical
designation of atomic positions covered.)

They banned thc vapes and any e-cig’s with cannabinoids a while ago. They banned smokable hemp too but it was being held up in litigation until this new ruling. This new ruling is the Texas supreme court upholding a decision from 2021 giving the DSHS power to enforce regulation and classification.

The ban applies to all synthetically created THC forms, including delta-8, delta-10, THCP and THCA flower. The one exception will be delta-9 products with less than 0.3% THC by dry weight. Low dose edibles, tinctures and drinks will remain available as long as they test within the 0.3% threshold.

Its a bit up in the air as to how people will be charged when caught, because possession of a few ounces of regular cannabis is still listed as a misdemeanor under a different law. It seems the new laws overlap and the new regulation considers anything with thca or over the .3% THC a potential felony.

Regular cannabis can test for thca and over the thc limits, nobody really knows how things will shake out. Texas is more of a charge first and figure it out later type of town. They’ll throw the book at you and see what sticks.

Another step in the right direction, because shit like this is just going to cause republican’s to lose their stranglehold on Texas.

You will be rewarded handsomely if you’re still doing indoor rosin out there in TX while all the hemp stores get shut down.

There’s some mega douche canoes out here in norcal shipping truckloads of d9 flower with paperwork who been bullying everyone on the hill buying up everyone’s spots so they can keep shipping truckloads of “hemp THCa flower” by the tractor trailer load to TX and maybe these guys will have to find a new sales pipeline before they keep taking everyones gardens just because they can sell their bows for $100-$200 more in TX.

But yeah I don’t want nobody going to prison for life let alone at all for marijuana. The pendulum will swing the other way one day and a correction will come.

@ECMachmer Don’t forget plain old incompetence. Glancing at the law and knowing how testing works I have a feeling we’ll see people with normal ass D9 product getting the book thrown at them because something tested with an infinitesimal small amount of something that looks like it could be synthetic or converted

Except the charge now is nearly identical for the same weight in heroin. The risk reward really don’t make much sense unless your desperate

There’s a small but growing medical market in Texas. Ridiculous the amount of restrictions they’ve put on it but some of the biggest cannabis companies were just issued licenses last year to start producing and dispensing. Trulieve is going to be opening stores in September. It’ll be pretty much a vape and MIP only market for awhile until some new leadership comes in, but it’s there and can’t be ignored.

So like what happens when it becomes legal and their power grid that’s as strong as McConnell eats shit since Tejas is lousy with data centers too. Are they gonna Enron off the weakest in their hospitals again so they can save some kwh?
