Legality today of hemp with higher than .3% thc

Hi, What is the latest on Hemp THC levels. If a farmer has hemp and it tests higher than .3% thc, what are his options. Years ago i know he had to burn it. thanks

If it test higher than .3% THC it is not hemp.

It would be considered a negligent violation, and the producer needs to have a corrective action plan.

thanks!..what types of corrective action would be available? I mean if it was already distillate we could remediate thc right? but at the biomass stage???

It seems like that has to do with the state or Indian tribe. But The states need federal approval for their remediation plans.

Thus there is very very little hemp biomass available :joy:
