Does anyone know the laws regarding cannabis in Italy?

I want to sell vapes on my website, for example, CBD oil has been limited again in Italy. So I want to know more about the law. I will be very grateful If anyone can share some relevant legal documents.

By Decree of Ministry of Health of 7th August 2023, which came into force on the 20thSeptember 2023, CBD to be ingested was included in the list of narcotic and psychotropic substances. Consequently, the sale of these products without a prescription became illegal.

However, on 24th October 2023, the Administrative Judge (TAR Lazio) suspended the effectiveness of the aforementioned decree, stating that CBD is not a psychoactive substance and it should not be included in the list of narcotic and psychotropic substances. This suspension by the judge allowed the resumption of the sale of CBD-based to be ingested products in Italy, thus confirming the lawfulness of the sale of light cannabis products.

Did you, try looking at the publicly available statutes?

I’m confused on why you would need someone to share these documents with you. There are also a number of summaries that have been provided out there.

There are clear laws for growing and making API from cannabis in Italy. And there’s a very clear program on who does this for flower products (only one approved medical source currently).

But that doesn’t sound like what you are interested in?

I think @cyclopath is right - sounds like you need an Italian LAWYER to talk you through the statutes and pending cases and injunctions and what not.

I’m not in Italy - but I do follow along with cannabis law and policy around the globe. I just checked again to see if there was any movement on proposed changes in Italy - I cannot find anything specific beyond that it has been proposed in committee for consideration.

As it was proposed at a time right before a very long recess (no really, like a 3 month recess) - one might consider that they haven’t really even started looking at it yet? And that they are all on holiday. And that you won’t see the outcome until later this year, perhaps around October, potentially a little sooner, but probably not until after August.

Anyway - there’s already published laws about medicines and CBD. There’s already published rules regarding the amount of THC allowed to be in those products.

And since Italy is still part of the EU - they are also under all the EU rules regarding this, which allow medicinal usage, etc. With a prescription from a doctor.

You can be an importer - but you have to get all the same things as all other importer of drug products. CBD is a drug product in the EU (at least based on my interpretation of the rules).

Anyway - find yourself a Qualified Person in Italy. I’m sure they can help. But I imagine just selling vapes on your website is outside of the currently allowed rules. You could have an online pharmacy that sold these products in Italy - but that is also probably not what you are asking about.

Internet sales are treated difrent than physical sales so make that clear to your adviser
But by law you are very limited
But sales are rampant and unregulated or checked and someone will take the heat eventually hope it s not you

On 25th May 2024, the Italian Government presented an amendment to Italian draft safety bill aiming at prohibiting the cultivation and sale of inflorescences of cannabis even with a THC content lower than 2%, for uses other than the permitted industrial and medical ones. The approval of such proposed amendment would imply the equalisation of so called ā€œlightā€ cannabis with a THC content lower than 0.2% and cannabis with higher THC content, which is illegal, as far as it is included among the narcotic substances.

Along the same restrictive lines, a sub-amendment was also filed on 29th May 2024, which even prohibits ā€˜the use of images or drawings, even in stylised form, reproducing the entire hemp plant or parts thereof on signs, placards, posters and any other means of advertising for the promotion of commercial activities’, in respect of which the failure to comply with would entail a penalty of imprisonment from six months to two years and a fine of up to 20,000 euro.

The texts are being examined by the Constitutional Affairs and Justice Committees in Parliament and they will be discussed and voted for the first time in the next months.

Again, you will need to pay a local legal specialist. Asking random strangers on the internet is not a strategy that will keep you out of jail.
