I wonder if they’re changing their strategy after that case that determined that any unlicensed garden regardless of size is a misdemeanor? @Patsykilledtony any insights?

Key Michigan Appeals Court rulings

Recreational growing is not a felony: In a January 2024 ruling, the Michigan Court of Appeals affirmed that growing marijuana for recreational purposes, even in amounts that were once considered a felony, is now only a misdemeanor. The ruling addressed an outdated law from 1978 and impacted thousands of prior convictions.

  • Growing 12 or fewer plants for personal use is explicitly protected under the Michigan Regulation and Taxation of Marihuana Act (MRTMA).

  • Felony charges for cultivation now only apply to manufacturing or distributing large quantities of marijuana for commercial purposes, not for personal use.

They could still get him for trafficking , but if they don’t know where or whom it was going to they may not be able to prove the case past simple possession.

A much easier case om the tax beef if the trafficking evidence is limited would be my best bet. Plus this is a better headline I think
