:man_facepalming: The DEA is the same as it ever was; flailing for job security by overextending their reach as federal drug law enforcementNOT legislation. There has been no “emergency scheduling” and even then, the DEA can only make recommendations, and again, only federally. In other words, inTRAstate (within one state) drug law is none of their business. They can only enforce against inTERstate commerce or movement of federally illegal drug trade. The practical upshot? As long as your state isn’t a pushover in the first place, and D8 has been legal there for trade, IT STILL IS.

As a natural (medicinal) food product…
The difference between decarboxylation and isomerization is directly analogous to the difference between cooking and baking. Simply using a bit of vinegar or citric acid while preparing an edible can cause isomerization. Anecdotally, the Δ8-THC isomer is largely regarded as less desirable than Δ9 or even undesirable to those who wish to use Cannabis to get high, anyway!

When it comes to regulation as a “drug”…
Delta 8 is arguably the “Dayquil” medicinal equivalent to the “Nyquil” of Delta 9 THC. D8 has shown to be a stronger anti-emetic and anti-inflammatory than D9 in most patients. The D8 isomer has the same or better analgesic qualities compared to D9, with far fewer side effects; little to no anxiety, not soporific (non-drowsy), shorter duration and less inebriating cognitively.

Yeah but most of my business was going to be out of state. (If anybody -in- Oregon wants compliant d8 I got you ! ) However, I recently got an endorsement by the OLCC to sell concentrates made from hemp into the rec shops up to 5%thc and reached out the them to ask what their policies are regarding d8 derived from hemp and they said it’s currently under discussion.

I will be sure to do so. I also have been in correspondence with the DEA since prior to the IFR and I supposedly have a written response regarding my d8 questions being sent to me… but I’m not holding my breath.
