I want d8 to be legal, too, but it isn’t. Healing people is great. Setting them up for arrest and possible imprisonment, not so great.
The real rub in all of this is that virtually all the d8 being sold as pure is not. It contains enough d9 to make it illegal on just that basis.

Cool, but none of that has anything to do with my point. That’s great that you are doing good with d8 – if it were me, I’d legalize all cannabinoids yesterday. But just because WE known it’s great doesn’t mean the public will see it that way. And yes kids smoke weed – and concerned parents societies are one of the biggest lobbies against legalization. Do you want hemp to be re-banned? The result of that will be LESS people having d8, not more.
It would be better to pursue d8 through the medical marijuana programs. That would get people help, without letting any kid with internet and a credit card get it.

I agree with what you did, and think communicating with government authorities is the right way to go.
But now if you want to claim legality, go get the same clarification from the dea, because the state of Texas has no say in how the federal authorities decide to interpret and enforce federal law.

You could have at least put a little work into this conversation and googled “persuasive authority.” A dictionary can be persuasive authority.
Tbh DEA would like to have an opinion but is losing the battle. I don’t value their opinion or the federal government that contradicts state laws.
The DEA isn’t targeting licensed thc businesses anymore. Either is the federal government and they haven’t even changed their rules.
Good luck getting them to go after Hemp businesses with documented history of asking permission.
I for one look forward to the day I can help right the wrongs of the DEA and what it’s done to my personal family.

And the other 3% is illegal d9, right? If you are at 97% you have really good stuff, a lot of the d8 out there sold as pure is 70%. 99% is possible (afaik true purity is extremely difficult.) But the last 1% d9 will still be illegal. That’s all it takes.
