Delta 8 grey area/legality

Autism, dude.

The DEA has tried to enforce drugs that aren’t scheduled before (cbd specifically) and lost

Here’s all the evidence you need, the same group that sued the DEA and won here is sueing over d8

IV. CONCLUSION
The DEA’s Final Rules purport to regulate foodstuffs containing ā€œnatural and synthetic THC.ā€ And so they can: in keeping with the definitions of drugs controlled under Schedule I of the CSA, the Final Rules can regulate foodstuffs containing natural THC if it is contained within marijuana, and can regulate synthetic THC of any kind.

Once again hemp derived isn’t synthetic

Please explain the difference hemp derived and synthetic, they can’t mean the same thing like what you’re claiming

tell me how using hemp feedstock and creating a chemical that wasn’t in there before isn’t synthesis

Isnt hemp below .3% thc. I think some people here mistake industrial hemp with low thc cannabis.

None of these people are extracting hemp per the definition so the whole hemp argument gets thrown out the window and we are all dealing with weed!

Wait, wait, wait… we came to an agreement last time this argument came up that compliant hemp does in fact exist and is in fact the feedstock for some people’s processes…

We came to an agreement it does exist but the majority aren’t using industrial hemp for feedstock. It’s about as rare as complaint D8…

there’s a not-very-vocal minority here running stuff that’s like 10% TAC +/-, I think they’re doing ok if they haven’t turned to conversions too

CBD is not a cannabimimetic. I see no relevance, but I also didn’t read that doc.

D8 is still a synthetic cannabimimetic, so feedstock is moot. ā€œCheck, and mateā€ says the DEA.

Umm, I think that omnibus spending bill is going to throw a wrench in the dea’s plans. They just got their hand slapped hard on WIP and told to stay in their lane.

Read the article, it’s a court ruling about what has to happen for the DEA to enforce a substance

It’s 100% relevant and has text that apply directly to this

No its not its hemp derived and it isn’t scheduled under the sythetic cannabinoid act of 2012

Here’s the link you can go through them all like I did

They took away all vape carts though which is a heavy price :frowning:

They certainly did not take away vape carts. They just raised the taxes to insane levels in liberal states. Very progressive.

@qma Will you still be able to ship emptys?

This is a dumb argument… We all know who’s right and wrong. Taking ā€œhemp derivedā€ cbd and performing a chemical synthesis to d8 is obviously a synthesis and obviously illegal, ask any real chemist with an actual degree, not the guy who is a f4200/IG superstar. Let him be the guinea pig for all I care, I’m jealous of his lawyers and how much money they’re making/going to make off of him.
